DMCA Copyright Policy

Webstorio respects intellectual property rights and expects its users to do the same. This policy explains how we handle copyright infringement claims for content hosted on the Webstorio platform, in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), and our Terms of Service.

1. Reporting Copyright Infringement

If you believe that content on a Webstorio project infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent.

Required Elements of a Takedown Notice

To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (a representative list is acceptable for multiple works).
  3. Identification of the allegedly infringing material, including the specific URL(s) of the Webstorio project(s).
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

Email your complete notice to [email protected]. We process DMCA notices received at that address. Notices sent elsewhere may not be reviewed promptly.

2. What Happens After You Submit a Notice

  1. We review your notice for completeness. If information is missing, we may contact you.
  2. If the notice is complete, we act expeditiously to disable access to the identified content.
  3. We notify the user who created the content that their project (or the relevant material) has been taken down and explain their right to file a counter-notification.
  4. We confirm our action to you when appropriate.

3. Counter-Notification

If you are a Webstorio user whose content was taken down and you believe the takedown was made in error—for example, because you have the right to use the content or the material was misidentified—you may submit a counter-notification.

Required Elements

Under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and its former URL.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement consenting to the jurisdiction of a U.S. federal district court (for your location if in the United States, or any U.S. judicial district if outside the United States).
  6. A statement that you will accept service of process from the person who filed the original takedown notice.

Email your counter-notification to [email protected].

After a Counter-Notification

  1. We review the counter-notification for completeness.
  2. If complete, we forward it to the original complainant.
  3. If the complainant does not notify us within about 10–14 business days that they have filed a court action to restrain the alleged infringement, we may restore the content.
  4. If a court action is filed, we keep the content offline pending resolution between the parties.

4. Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, Webstorio will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.
